A-1. Terms of use

By accessing this website, you acknowledge and agree to its policies and terms. It is important that you read these policies and terms. A-2. Site reserved for Canadian residents

This site and these policies and conditions apply only to individuals residing in Canada who access one of La Cordée's websites (identified on www.lacordee.com).

You agree to indemnify and hold harmless La Cordée and its affiliates from all claims, losses or damages whatsoever arising from or caused by (1) your breach of these terms and (2) your use of this website, including any claim for infringement of any intellectual property right of any third party.

This article shall remain in effect even if this agreement is terminated or ends.

A-6. Applicable law and application territory

A-10. Divisibility

The provisions of this agreement are deemed severable. If any provision is declared unenforceable or invalid, it shall nonetheless be enforced to the fullest extent permitted by law, and such declaration shall not affect the validity or enforceability of the remaining provisions.

A-11. Integrality of the agreement

This agreement, together with all other agreements, terms, and conditions incorporated herein by reference or mentioned herein, constitutes the entire agreement between you and La Cordée regarding the subject matter hereof, the use of the website, and the transactions made on or from this website, and it supersedes any prior agreements or understandings (electronic, oral, or written) relating to the subject matter hereof, and they may only be modified in writing or if La Cordée makes the changes in question available to you in accordance with this agreement.

A-12. Lack of renunciation

The fact that La Cordée does not assert a provision of these terms or does not follow up on a breach of these terms by you or a third party does not in any way mean that La Cordée waives its right to assert the terms of these terms or to follow up on similar breaches.

The terms "you" and "your" used in this agreement refer to the person accessing the website www.lacordee.com for any purpose whatsoever.

At La Cordée, we process your personal information to better serve you by enhancing your experience on our website.

This privacy policy identifies the information we collect, use and share with our partners and how we protect it, and informs you of your rights with respect to that information.

Any information that identifies you is personal information and depends on how you interact with us.

When you purchase a gift card as a gift, we collect the name and email address of the recipient and the personalized message that accompanies the gift card in order to send it on your behalf to your recipient.  

When you subscribe to our newsletter, by means of an explicit, voluntary and informed consent in compliance with the Anti-Spam Act (C-28), or fill in the appropriate forms, we may collect your email address, first name and last name. We use this information to communicate with you or to send you our newsletter. You can define personal preferences, your language and your month of birth. This information helps us to personalise the content we send you.

When you create an account on our website or become a member, we may collect your name, email address, telephone number, postal address, language preference, purchase history, products, login and password. This data enables us to manage your account and our internal database efficiently. 

When you complete surveys to improve our service and your experience, we may collect your first and last name and email address depending on your approval and the level of confidentiality of the survey.

When you participate in contests that comply with and are registered with the Régie des alcools, des courses et des jeux (Québec), and other regulatory requirements. We may collect your name, email address, telephone number, postal address and language preference.

When you apply for a job, we may collect personal information, including your name, telephone number, email address and certain information in your curriculum vitae. This information may be used to process your application and will become part of your employee file.

La Cordée may use your personal information for a variety of business purposes. For example, the personal information we collect may be used to assist you when you send us a suggestion, request or complaint; to provide you with digital content tailored to your needs; to process your orders; to maintain your account; to evaluate your application when you apply for a job; to help us identify and counter fraud; to keep you informed of our events, contests and promotions; to allow us to process your returns and refunds and to allow us to identify and respect your preferences on our website.

B-3. To whom do we disclose your personal information and for what purpose?

We may share some of your personal information with members of our group of companies, with third parties acting on our behalf and at our direction, and where permitted or required by law. La Cordée does not sell or rent any personal information about our customers and members to third parties.

When you place an order online, we request only the information necessary to process and ship your order and payment. We share this information with third party delivery and credit card processing companies who are responsible for delivering your order and processing payment. We only pass on the information that is necessary to carry out these tasks.  
We may use third party providers such as Google Analytics to analyse our website services. This type of supplier may install cookies on the User's device when visiting our website. B-4. Where do we keep your personal information?

Your personal information collected by La Cordée is stored on cloud servers hosted by Amazon Web Services and ADOBE located in the United States and/or Canada. The transfer of data to the United States is carried out in accordance with the standard contractual clauses approved by the European Commission for the protection of personal information transferred outside Europe. In addition, these cloud service providers employ the best security measures.

B-5. What measures do we take to protect your personal information?

We act in strict compliance with the privacy legislation applicable to us, including, for the province of Quebec, the Civil Code of Quebec and the Act respecting the protection of personal information in the private sector (RLRQ, c. P-39.1).

We have implemented reasonable technical, administrative and physical security measures to protect your Personal Information. These measures take into account the sensitivity of the information, the purpose for which it is to be used, its quantity, distribution and medium. 
We use suppliers who implement appropriate measures to manage and protect the Personal Information entrusted to them.

We use commercially reasonable means to protect the integrity of our website and the confidentiality of the information we collect. We also limit access to the Personal Information we collect to those persons for whom this information is required to fulfill the purposes described above. However, despite the security measures taken by La Cordée, there is a risk of an illegal cyber attack by a third party that could steal Personal Information without La Cordée's consent.

We have a policy against unauthorized disclosure or use of Personal Information, and we train our employees in respect of this policy.

D-1. Order

Before submitting an order for products, you must first confirm the order by clicking on the button identified for this purpose (the "Order Confirmation"), which includes the product(s) ordered, the purchase price, shipping charges and applicable taxes. Prices and availability of items offered on our website are subject to change without notice. We go to great lengths to display available items and update our inventory on a regular basis.   

However, it is possible that an item, size or colour may be unavailable at the time of your order.  

Once your order has been processed, you will receive an order confirmation indicating the date of receipt, availability and price of each item ordered. In certain unforeseen circumstances, it may be necessary to cancel an order if items cannot be shipped.

Despite our best efforts to meet your needs, we reserve the right to revise an inaccurate price or a product description and to cancel or refuse an order for an item with an inaccurate price or description. These corrections may be made after the order has been accepted.

D-5. Payment terms

Payment methods are established by La Cordée, at its discretion, from time to time. Payment will be made by credit card approved by the financial institution that issued the credit card, unless another predetermined method of payment has been previously accepted by La Cordée.

 
Unless otherwise indicated, prices do not include shipping and handling charges or applicable federal and provincial sales taxes and any other value-added tax, use tax, goods and services tax, harmonized sales tax and other taxes and duties related to the order. All taxes and fees must be paid before the purchased products are sent to you. These charges will be presented separately for each order in the order confirmation, as applicable.

D-6. Shipping & taxes

La Cordée will ship the ordered products according to the delivery method you have chosen and to the address (in Canada only) indicated in the order confirmation. The delivery times indicated by La Cordée are approximate, and La Cordée is not responsible for damages or costs resulting from delivery delays.

D-7. Ownership & risk of loss

The products are delivered by an independent delivery company under the terms of a delivery contract. You become the owner of the products and assume the risk of loss from the moment La Cordée delivers the products to the delivery company.

D-8. Returns

The returned products are subject to the return policy, the terms of which are available on La Cordée's website (www.lacordee.com), the terms of which are incorporated herein by reference. Certain restrictions may apply.
